01Who we are

This website at sourcewyse.com and the free tools on it (together, the "site") are provided by SourceWyse Knowledge Systems, a sole proprietorship based in Goleta, California ("SourceWyse", "we", "us"). You can reach us at jim@sourcewyse.com. The name of its owner is available on request for legal purposes.

02Accepting these terms

By using the site, you agree to these Terms of Use and to our Privacy Policy. Before you run the coverage snapshot, you confirm your agreement by ticking the box beside it. If you do not agree, please do not use the site.

If you use the site on behalf of a company, you confirm that you are allowed to accept these terms for it.

03Business use only

The site is meant for hotel owners, managers and others acting for a business. It is not directed to consumers or to anyone under 18.

04The coverage snapshot

The coverage snapshot reads the public pages of a website you name and lists places where those pages appear to disagree with each other.

Only for websites you are authorized to act for

You may run the snapshot only on a website that you own or that you are authorized to act for. Each time you use it, you confirm that this is true. Do not use it on a competitor's website or on any website you have no authority over. We may check your authority, for example by matching your email domain to the website, and we may refuse, limit or stop any snapshot.

What it reads

The snapshot reads publicly available pages once, at your request. It does not sign in, submit forms or read anything that is not public.

What the results are

Results are produced automatically, may be incomplete or wrong, and reflect the pages as they were when read. They are for your information only. Check any finding against its source before acting on it. Results are for the property's own use; do not publish them or present them as our assessment of any business.

How long we keep them

We keep the website content and results for up to 30 days, so we can deliver them and prevent misuse. If you create an account within the seven days the results link works, they become part of your account.

We keep a short record of your confirmation of authority, covering the website, the time, your IP address and the version of these terms, for four years as evidence of your agreement. The Privacy Policy explains more.

05Acceptable use

You agree not to:

• use the site in a way that breaks any law or infringes anyone's rights;
• copy, scrape or harvest the site or its tools by automated means;
• submit snapshots in bulk or by script;
• try to get around limits, security or access controls;
• probe, test or disrupt our systems without our written permission;
• upload or send anything harmful, such as malware;
• misrepresent who you are or whom you act for; or
• use the site to build a competing product.

06Demonstration content

The Verano Inn and every person, vendor, document, fee and figure shown with it are invented to show how SourceWyse works. They are not real businesses, people or policies, and any resemblance is coincidental. Demonstrations are illustrations, not a promise of how the service will perform for any particular property.

07Descriptions, prices and offers

The site describes SourceWyse Studio and SourceWyse Managed in summary. Nothing on the site is an offer that you can accept. Prices are in US dollars, exclude any applicable taxes and may change at any time before you sign.

If you buy anything, the Studio terms you accept or the Managed agreement you sign govern. They take priority over anything on the site, including its descriptions of the guarantee, the response commitments, features and publications.

08No professional or safety advice

Nothing on the site is legal, regulatory, accessibility, insurance, safety or other professional advice.

SourceWyse organizes and displays content that each property supplies and approves. Each property remains responsible for its own policies, for the accuracy of its content, and for complying with fire, building, health, labor and other laws and codes. Emergency and safety content is never a substitute for calling 911 or for qualified fire, life-safety and medical professionals.

Parts of SourceWyse, including the coverage snapshot and the staff assistant, use artificial intelligence, which can misread or miss things. SourceWyse is designed to cite its sources and to decline when it has none, but you should confirm anything important against the underlying document, especially anything about money, safety, legal or medical matters.

10Our content and your feedback

The site, including its text, design, graphics, software and the SourceWyse name and marks, belongs to us or our licensors. You may view and use the site to evaluate SourceWyse, and for nothing else. You may not copy, modify or republish it without our written permission.

If you send us ideas or feedback, you allow us to use them without any obligation to you.

11Other websites and providers

The site may link to other websites and relies on third-party providers to run. We are not responsible for other websites, and your use of them is governed by their own terms.

12No warranties

The site, the coverage snapshot and all content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the site will be uninterrupted, error-free or secure, or that any result will be complete or correct.

13Limits on liability

To the fullest extent the law allows: (a) we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the site or the coverage snapshot; and (b) our total liability for all claims relating to the site and its free tools is limited to one hundred US dollars (US $100).

These limits apply whatever the legal theory, even if we were told the damage was possible. They do not limit any liability that the law does not allow to be limited. Paid services are governed by the limits in their own terms.

14Responsibility for misuse

If you use the site in breach of these terms, including by running a snapshot on a website you are not authorized to act for, you agree to cover the reasonable losses and costs, including reasonable legal fees, that we incur as a result, including from claims by others.

15Governing law and disputes

California law governs these terms, without regard to its conflict of laws rules.

Before either of us files a claim, we agree to try to resolve it by talking directly and in good faith for at least fifteen days, starting when one of us sends the other written notice describing the issue. If that does not resolve it, disputes go to the state or federal courts located in Santa Barbara County, California, and both of us consent to their jurisdiction.

16Changes and ending access

We may update these terms by posting a new version with a new effective date. The version in effect when you use the site applies. We may change, suspend or end any part of the site, or your access to it, at any time.

17General

If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term, that is not a waiver. You may not transfer these terms. We may transfer them, including to a company formed to operate SourceWyse. These terms and the Privacy Policy are the whole agreement between you and us about the site.
